San Bernardino Divorce Modification Attorney

Southern California Modifications of Divorce Laws

Divorce truly is not the end of the world. Life moves on, and the role of your divorce lawyer is to help you get a divorce agreement that meets your needs with regard to finances and any children of the marriage.

But because life does go on, and because life changes, divorce orders often need changing as well. When financial or other circumstances change, California law allows for modification of divorce orders with regard to child support, child custody or visitation agreements.

At the La Verne La Verne Modifications law Offices of Stephanie J. Squires, we focus exclusively on serving the divorce-related legal needs of our community. For more than a decade, attorney Stephanie J. Squires has represented both husbands and wives in new divorce cases as well as in petitions for modifications of divorce orders.

California law allows modification of divorce orders under several circumstances.

  • Modifications of child support orders: When either parent's financial circumstances change significantly, either parent may request modification of a child support order. Common examples include situations in which the paying parent loses a job or in which the receiving parent gets a job or a promotion. It is important to file a formal request for a modification of the order rather than simply agree informally to change the child support amount. If you do not formally change the child support order, the paying parent could face unreasonable court sanctions for nonpayment of the correct amount of support.
  • Modification of child custody orders or visitation plans: Often, parents want modification of orders relating to child custody or visitation. Common examples of circumstances that warrant a modification of orders relating to child custody are: (1) a parent exhibits abusive or neglectful parenting behavior; (2) move-away or parental relocation cases; (3) a parent is convicted of a crime or becomes seriously ill. Modification of child custody orders may also be possible when a grandparent or other relative wishes to gain parental rights via a custody order.

Modification of orders can be simple or complex, much like the original divorce process. If the ex-spouses are able to communicate amicably, modification of the orders should be relatively straightforward. However, if one parent wants a major change that the other parent does not want, a long and conflict-filled legal process may result.
